I recently made a very poor choice and got behind the wheel of my car after I had been drinking. As a result of that poor choice I am now in a diversion program in Oregon. As part of that diversion program I am required to have an Ignition Interlock device installed on my car. Although I agree with the concept, I believe this device is very unsafe and creates a dangerous driving distraction. I totally agree with having to provide a proper breath sample to get the car to start BUT due to people trying to circumvent the system you have to retest again at 5 minutes and every 30 minutes after that.

Oregon law states that is illegal to text or talk on the phone while driving, unless using a hand’s free device. In other words you can use a “hands free” device but if you’re holding it in your hand it’s considered a distraction and you are now a distracted driver. Using the ignition interlock device poses a real danger on the road as you have to first find the device (it’s not mounted anywhere, could of possibly fallen on the floor) hold this device in your hand, preform the test and pass the test all while you are driving. You only have several minutes from the time it asks for a retest to pass a test. If you do not complete the retest correctly you receive a violation. The sequence of events involved not only in manipulating the device but providing the correct steps in the right sequence to provide a breath sample, require a considerable mental and physical effort when blowing into the handheld monitor and driving in traffic. All of this together, all at the same time, will result in an unacceptable driving distraction possibly further resulting in an accident. Any time you are driving this is dangerous but specifically if you are in heavy traffic, on a busy freeway or poor weather conditions this can be extremely dangerous.

The manufacturer claims that you should exercise safety first and that the device is designed to allow you to continue driving and safely retest without taking your eyes off the road. However if you are uncomfortable it is recommended that you pull off the road. You have to take your eyes off the road to grab the device and pulling off the road could result in a dangerous situation as now your stress level is high and you could be doing dangerous maneuvers, improper lane changes just to pull over in time to take the test and not get a violation.
